Virginia home-grow compliance checklist

Clone Source · Updated October 2026

Virginia adults have been able to legally grow cannabis at home since 2021, and retail sales begin July 1, 2027 under the budget compromise passed in June 2026. This checklist covers what is and is not allowed for home cultivation today. Rules can change; verify against current Virginia law before acting.

The short version: adults 21 and over may cultivate up to 4 plants per household for personal use. Plants must be tagged with the owner's name and kept out of public view. This has been unchanged since 2021; the 2026 law adds retail sales; it does not change home cultivation.

What changes in July 2027

Retail sales through licensed dispensaries begin July 1, 2027. Home cultivation rules (4 plants per household, 21+, tagging, out of public view) are unchanged by the new law. If you grow today, you are already operating under the same limit that will apply after retail opens.
